Well, found this comment at NewsForge; valid or not, who knows:

Regarding IBM freeing the source for OS/2 - I have been told that when the subject was brought up with some senior Microsoft people they said they would have no objections to it. I was also told by the same person that IBM refuses to do this because of the cost involved in tracking down all the owners of copyrighted code in the source. IBM estimated that it would cost over $500 million to do this and that there was no business gain from doing so.

Even if IBM only open sources the parts that they own, it would be a great help to those wanting advance OS/2-eCS and/or the OSFree project.

Well, how much help would it be to get hold of the WPS and SOM code? That at least don't have any MS code and is pure IBM code
